Peabody Energy, America’s largest coal company, has filed a 240-page legal challenge against the U.S. Environmental Protection Agency, saying it relied on flawed climate change science when it decided to regulate greenhouse gas emissions.

Peabody filed a petition in the U.S. Court of Appeals for the District of Columbia on Feb. 12, seeking a review of the EPA’s decision in December that greenhouse gases pose a danger to public health, BusinessWeek reported.

The EPA’s “endangerment finding” would allow regulators to control carbon dioxide emissions from coal-fired power plants under the Clean Air Act.

“Peabody is, in effect, challenging the right of the current U.S. federal government to introduce cap-and-trade regulations by the ‘back door,’” the Climate Depot Web site observed.

Peabody maintains that the finding relied too heavily on a United Nations panel’s disputed work, according to BusinessWeek.

The U.N.’s Intergovernmental Panel on Climate Change concluded in 2007 that carbon dioxide and other greenhouse gases are “very likely” to blame for global warming.

But that conclusion was challenged following the “climategate” scandal, when e-mails leaked in November from the University of East Anglia’s Climatic Research Unit in Britain indicated that researchers sought to keep some data out of the U.N. body’s findings to bolster their case for man-made global warming.

Peabody’s petition argues that the EPA must reconsider its endangerment finding “based on all the new material from climategate that was not available during the original EPA ‘comment period’ and which is central to the outcome that EPA reached,” Climate Depot disclosed.

Peabody spokeswoman Beth Sutton said in a statement, “There is no sufficient basis to implement regulations that would harm a fragile economy, further suppress investment and raise energy costs for Americans.”

St. Louis-based Peabody had sales of 244 million tons of coal last year. Its coal products fuel 10 percent of all U.S. electricity generation and 2 percent of worldwide generation.

The Obama administration made “grave miscalculations” in pushing for healthcare reform just as his predecessor George W. Bush erred with the invasion of Iraq, political analyst Charlie Cook observed.

Cook, editor of the Cook Political Report, said in an interview with National Journal that “when unemployment numbers started proving to be much, much tougher and it started becoming more clear that the stimulus package hadn’t worked properly, [Democrats] just kept plowing ahead on healthcare.”

“I think they made some grave miscalculations and as it became more clear that they had screwed up, they just kept doubling down their bet.”

Obama and the Democrats’ miscalculations have been “of proportions comparable to President George W. Bush’s decision to go into Iraq,” Cook declared.

“Bush went, ‘We’re going to go after Afghanistan as a reaction to 9/11,’ and then pretty soon got distracted and obsessed with going into Iraq with varying rationalizations that sort of evolved over time.”

Cook also predicated the tea party movement could have a “huge impact” on the political scene, and said “it’s hard to come up with a scenario where Democrats don’t lose the House” in November.

The Republicans have problems, he acknowledged, but added: “If I had a choice of the Republican Party’s problems right now or the Democratic Party’s problems, I think you could triple the Republican Party’s problems and I’d still rather have their problems than the problems facing Democrats.”

Feb. 26 (Bloomberg) -- Fridays are getting tense in the Chicago campaign office of Alexi Giannoulias, the Democrat seeking the U.S. Senate seat once held by President Barack Obama. That’s the day regulators announce which troubled banks they’ll close.

Broadway Bank in Chicago, owned by Giannoulias’s family, must attract at least $75 million in capital by late April to meet terms of a consent order with the Federal Deposit Insurance Corp. prompted by losses on commercial real-estate loans. Even if successful, the family could lose control before November’s election, dealing a blow to Democrats and an Obama friend.

“The last thing that Alexi Giannoulias needs right now is another round of bad news stories and stories raising questions about the family’s business,” said Stu Rothenberg, editor of the non-partisan Rothenberg Political Report. “The one thing you don’t want to spend in a campaign is a lot of time defending yourself.”

The fate of the $1.2 billion-asset Broadway Bank, whose wealth helped finance Giannoulias’s successful 2006 state treasurer bid, is playing a growing role in a contest for a seat the Democrats have unexpectedly found themselves defending and that may help determine whether Obama’s party can keep its Senate majority. Recent polls show Giannoulias in a tight race with Mark Kirk, a five-term Republican congressman from Chicago’s northern suburbs.

Consent Order

One week before Giannoulias won the Feb. 2 primary, the FDIC and the Illinois Department of Financial and Professional Regulation issued the consent order.

“The family is committed to contributing to recapitalizing the bank, but doesn’t have the full amount required,” said Tilden Katz, a Broadway Bank spokesman. “Any capital infusion will take place alongside private investors and longtime customers who have said they will stand with us.”

Failure to raise the money would make a takeover of the bank by the FDIC more likely, said Matthew Anderson, a partner with Foresight Analytics.

Capital Challenge

“It’s a challenging environment to raise capital,” he said. “An enforcement order from regulators would tend to raise some alarms among investors.”

Broadway was one of 188 undercapitalized banks out of more than 8,000 nationwide in the fourth quarter of 2009, Anderson said. While the broader economy shows signs of improvement, some community banks continue to struggle. Regulators are closing them at the fastest pace in 16 years.

Broadway could be closed if additional loans go bad, even during the 90-day period covered in the consent order signed Jan. 26, Anderson said.

Kirk, 50, has highlighted Broadway’s struggle and said a closing would pose “significant problems” for Giannoulias, 33.

Some of the Broadway loans that have generated controversy involve Michael Giorango, a convicted bookmaker and prostitution-ring promoter. It has also made loans to convicted Illinois influence peddler Antoin “Tony” Rezko and a family accused of having connections to organized crime.

“I was not inside any loan transaction with mob figures, and I was not inside the Broadway Bank,” Kirk told reporters Feb. 19.

Senior Loan Officer

Giannoulias worked as a senior loan officer and vice president at the bank after graduating from Boston University and Tulane University Law School. The campaign committee for Obama’s 2004 U.S. Senate run banked there, and the two men have remained basketball-playing buddies.

Giannoulias and his two brothers are among the privately held bank’s owners, Katz said.

“When I left nearly four years ago it was healthy, profitable and very well capitalized,” Giannoulias said in a statement. “Hundreds of community banks that didn’t get a dime of bailout dollars are struggling, and Broadway Bank is no exception.”

He said he would not have made some of the loans to controversial figures had he “known then what I know now.”

His campaign presented figures showing 9 percent of about $240 million in non-performing assets now on the bank’s books originated while he was there.

Republicans criticize Giannoulias for not answering more questions about the bank. His chief rival in the Democratic primary also questioned his time at the institution.

Family Dividends

In November, Giannoulias defended about $70 million in dividends paid to family members in 2007 and 2008, saying much of the money went to income taxes after his father’s death.

He alone couldn’t make a significant dent in the capital needed to comply with the regulators’ order, his public records show. His most valuable non-bank asset is a $1.5 million Chicago condominium purchased in 2007.

Giannoulias, who is single, has $15,001 to $50,000 in deposits at Broadway, according to a disclosure report he filed in March. His 3.6 percent ownership in Broadway Bank was valued at $1 million to $5 million.

Rothenberg said he sees a slight advantage for Kirk because of the bank controversy and this summer’s corruption trial of former Illinois Governor Rod Blagojevich, a Democrat.

“The timing seems right for Kirk,” he said.

President Barack Obama’s budget has added more than $100 billion of federal taxpayers’ money to what is called “education,” so that means it will be spent by alumni of the Saul Alinsky school of radical community organizing and/or the Chicago Democratic machine. We’re indebted to Pamela Geller of AtlasShrugs.com for exposing the shocking use of some of these funds.

Obama is using the public schools to recruit a private army of high-schoolers to “build on the movement that elected President Obama by empowering students across the country to help us bring about our agenda.” We now know that Obama’s “agenda” is to move the United States into European-style socialism.

Obama’s Internet outreach during his campaign, Obama for America, has been renamed Organizing for America (OFA) in order to recruit students to join a cult of Obama and become activists for his goals. Geller discovered that the teacher of an 11th-grade government class in Massillon, Ohio, passed out the sign-up sheet, headed with Obama’s “O” logo, asking students to become interns for Organizing for America.

These interns will be given an intensive nine-week training course using comprehensive lesson plans. Assigned readings include Saul Alinsky’s notorious “Rules for Radicals,” “Stir It Up: Lessons From Community Organizing and Advocacy” by the left-wing activist Rinku Sen, and particular sections of “Dreams From My Father” dealing with Obama’s days as a community organizer in Chicago.

Republican students will be filtered out of the intern program by requiring applicants to answer questions that reveal their politics. One example is, “What one issue facing our country is important to you and why?”

Geller said the purpose of this training to become Alinsky-style community organizers is, “of course, to elect more Democrats.” The internship program is specifically geared to get the kids working in the 2010 elections.

The sign-up sheet for Organizing for America starts with this instruction: “Organizing for America, the successor organization to Obama for America, is building on the movement that elected President Obama by empowering students across the country to help us bring about our agenda of change.” The application explains that this national internship program is “working to make the change we fought so hard for in 2008 a reality in 2010 and beyond.”

This is not the first time Obama has tried to enlist schoolchildren into an Obama cult. Last fall, the instructions mailed to every school by Secretary of Education Arne Duncan added a very political dimension to Obama’s speech that was broadcast to public school children on Sept. 8.

Geller explained the extensive political dimension of the new intern program. The OFA student interns will be trained in the goals and language of the left: “antiwar agitation, anti-capitalism, Marx, Lenin, (Bill) Ayers, LGBT agenda promotion, global warming, soft-on-jihad and illegal immigration.”

Another item on OFA’s reading list is “The New Organizers” by Zack Exley. It brags about “an insurgent generation of organizers” inside the Obama campaign that has “almost without anyone noticing … built the Progressive movement a brand new and potentially durable people’s organization, in a dozen states, rooted at the neighborhood level.”

The 10-page “National Intern Organizer Curriculum” is very specific in describing the tactics that interns will be taught. It includes these components: “Using Story as an Organizing Tool, Building Relationships and Building Teams, Mobilizing to Win on the Issues (issue advocacy), Health Care Service Project.”

Passage of Obamacare is one of this intern project’s major goals. The curriculum promises to provide “insight on the strategy and plan behind the health care campaign” and “further motivate them to work on the issue.”

The sign-up sheet states that the “purpose” of training these students is “to build community” among the interns and teach them “to be leaders in OFA’s organizing work.” After all, Barack Obama knows a great deal about being a community organizer — that was his only real job before he got into politics.

Job prospects may be bleak for many Americans, but they will be rosy for alumni of Obama’s intern program. After the students have been fully trained as Alinsky-style community organizers, they will be eligible for jobs in Senior Corps, AmeriCorps or Learn and Serve America.

Those three so-called “service” organizations, which annually dole out millions of dollars to left-wing groups, are overseen by the Corporation for National and Community Service. The U.S. Senate just confirmed this Corporation’s new chief executive, Patrick Corvington, who was a senior official of the Annie E. Casey Foundation, which has given over a million and a half dollars to the ACORN network of organizations.

Taking the First Step. Republicans listened to the American people and have produced a common sense, fiscally responsible health reform proposal—not Speaker Nancy Pelosi’s 2,000+ page government takeover of 1/6th of our nation’s economy. Republicans have a better plan, one that lowers premiums for working families and small businesses, fights fraud, and will lead to expanded access to affordable health care coverage for all Americans without raising taxes, cutting benefits to seniors or spending money we don’t have.
 
1.  Lowers Health Care Premiums.
     According to CBO, the Republican Alternative would reduce health insurance premiums by up to:
• 10% for employees who get coverage through a small business (50 or fewer employees)
• 8% for those who do not have access to employer-provided coverage
• 3% for employees who get coverage through a large business


All told, under the GOP plan, premiums for millions of families would be nearly $5,000 lower than Speaker Pelosi’s cheapest insurance plan, according to CBO estimates.

2.  Guarantees Affordable Coverage for Patients with Preexisting Conditions.

The Republican Alternative makes it illegal for an insurance company to deny coverage to someone with prior coverage on the basis of a pre-existing condition. So if you lose your health insurance because you lose your job, move, get divorced, or just want to change plans, you are protected. Through a new Universal Access Program, all patients with preexisting conditions will have access to affordable health care coverage--without waiting lists. The Republican Alternative also prohibits an insurer from cancelling a policy unless an individually knowingly commits fraud on an application form. It also prohibits insurance plans from instituting annual or lifetime spending limits.

3.  Protects Seniors Medicare Benefits.
Unlike the Pelosi bill, seniors’ benefits are not cut and nothing in the Republican Alternative will increase seniors’ Medicare premiums.

4.  No Tax Increases. Period.

5.  Encourages Small Businesses to Offer Health Care Coverage,  Without Taxing Job Creation.
Unlike the Pelosi bill, which punishes small businesses with onerous mandates and exorbitant taxes that CBO says will be passed on the employees in the form of lower wages, the Republican Alternative plan gives small businesses the power to pool together and offer health care at lower prices, just as corporations and labor unions do.
6.  Enacts Real Medical Liability Reform.
The Republican Alternative saves $54 billion by helping to end costly junk lawsuits and curbing defensive medicine by enacting medical liability reforms modeled after the successful state laws of California and Texas.
7.  Empowers the Doctor- Patient Relationship.
The Republican Alternative eliminates taxpayer funding of a program that could lead to government intrusion in the doctor-patient relationship and the rationing of care on the basis of cost. Unlike the Pelosi bill that increases taxes and expands price controls on medical devices and prescription drugs, the Republican Alternative promotes innovation and places greater emphasis on prevention and wellness.
8.  Prohibits Abortion Funding.
The Republican Alternative explicitly prohibits all federal funds from being used to pay for abortion.
 
9.  No Entitlement Expansions Forcing Americans onto a Government Run Plan.
The Republican Alternative avoids a dramatic expansion in entitlement spending and reverses pressure to enact enormous additional tax increases in the future, including on the middle class.
10.  Reduces the Deficit.
According to CBO, the Republican Alternative reduces the deficit by $68 billion over the next ten years and continues to reduce the deficit in the second budget window.

Can't Get Through to Your Senator or Congressman? Call the Media!
 
As you already know, it has become virtually impossible to communicate with your elected representatives.  Senators are taking their phones off the hook, unplugging their fax machines and ignoring the thousands of emails pouring into their computers.  They simply aren't interested in hearing from you.  Against overwhelming public pressure, and polls which continue to show that an increasingly large majority of Americans oppose what they are doing, the Senate appears poised to pass a health care bill which none of them have even read.  And yet even as public outrage and anger grow, the media is remiss in its coverage, pretending that we don't exist.    So now it's time to change strategies. 

While we want you to continue to call your Senators, any time you can't get through, we encourage you to call your local radio and television stations and newspapers to express your outrage at your continuing inability to reach your elected representatives.  When we melt the switchboards of the media outlets, it becomes far more likely that they will begin reporting on your outrage.  If thousands of people in each area are calling their media outlets, they will struggle to handle the flow of calls.  While Senators may ignore us, the media outlets are businesses that cannot afford to stop answering our calls.

Don't give up...the battle is not over.  The fight is in full swing, and it's up to the Patriots around the nation to make the difference.  You are the future of this nation, and only you can make the difference.

Democrats are planning to try to push through the president's plan, after a show summit with Republican leaders on Feb 25. They apparently plan to bend to their purposes a tricky maneuver called "budget reconciliation" (a trillion-dollar bill does affect the budget) - which is aptly called the "nuclear option." It blasts away the usual defenses such as hearings, debates, or filibustering. It would also turn traditional American medicine and insurance into a smoldering ruin-not the objective they advertise!

The first two rails of total government control have already been laid, observes long-time AAPS member Lee Vliet, M.D., in the "stimulus bill." If you are not their constituent, you should tell them that their vote represents the American people, as well as their constituents, and you expect them to listen to and represent the American people.
3. Contact the Republican Leadership and let them know that we are watching and waiting.  We expect every single member of the Republican party to stand on principles and values, while representing the American people.

Who is the Tea Party?

I can see by the comments left by others, they must be either young, cynical, illiterate of the government process or just do not understand the historical significance to the Tea Party Movement.

WE are solid citizens from every walk of life, educational level, and professional training but we have several things in common:
1. a love of federalist democracy as established by our Constitution,
2. limited government interference into our private lives,
3. fiscal responsibility by the elected officials
4. support of the Bill of Rights
5. The willingness to work to earn what we have
6. We do not look to our Government to give us everything we need or want
7. We believe in exercising our rights at the ballot box not running off at the mouth complaining

and many more basic freedoms we are afforded under the tenets set up by our Founding Fathers

BASICALLY WE ARE THE FORMER SILENT MAJORITY

How many of you know the history of the United States? why did we rebel against King George III in 1776?? - how the Soviet Communists came into power?? - how Hitler took over the German Government by taking away rights and freedoms we take for granted with so many of our population becoming apathetic to why we are afforded these freedoms,.. when we do not heed the call to action as a part of our democratic process, then we will loose every freedom we have..

The Tea Party movement is just an exercise of our Right of Speech, guaranteed under the Bill of Rights, an exercise of our right to Assemble, our Right to be part of our Government..

Letter to David Brooks of NY Times

Sir,

On many statements you made on the Charlie Rose show concerning the Tea Party Movement, pertaining to the reelection of Obama, and other ideas you were forwarding of similar nature to which I and many Tea Party persons wholeheartedly disagree.

1.  You are only understand a minimal portion of what is driving the minds and hearts of the average, blue collar working citizen.  Not all of us are high school or with 'some'  college education but there are those of us have college or University degrees.  WE come from many walks of life. What the Elitist do not understand is that common sense better known as life experiences is a driver of our judgments and sensibilities not education. Christian values that are taught from the Bible,  moral ethics, and principals still reign as guidelines for our lives.  These are values we all believe the politicians and educators have written out of their books.  Conservative values upon which this country was founded on and should still be the guiding beacon for ALL our leaders today.  We do not want government telling us how or when to work, what doctor we can see, what school we can send our children to or even if we can participate in a religious activity.  We ARE NOT SHEEP!; you can not tell us what you want us to hear and have us believe it as you told us!!

2.  We STRONGLY believe in the U.S. Constitution and Bill of Rights as the documents our governmental leaders shall abide by not who gave them the most money.  It is our belief these documents are the standard EVERY LAW, REGULATION, SUPREME COURT DECISION shall be compared to.

3.  We believe Government is not the do all end all entity.  Government has it's place!! as military protection of the population, legal enforcement, providing infrastructure where the local community controls the way programs are implemented..

The items above are only a few of our beliefs!!  You need to come to understand there are people in the Tea Party movement who are very well educated by your standard but we are principally opposed to the "cramming down our throats" of government control.  We are the ones who have the knowledge of who to express our dissatisfaction with the events, methodology, or any other means the 'silent majority' is being led to slaughter.  We also lend our knowledge and skills to give a hand up to our lesser educated brethren who feel the same way we do, we willingly give them a voice,..
